These General Terms and Conditions are an integral and supplementary part of an order placed with the Seller with Org Number CHE462179861 based in Baar (Switzerland), for orders placed via the Internet or by telephone.

Offers Copyright

Unless otherwise agreed, the items will be delivered according to the illustrated sample or model and its description. Deviations in colour, structure, workmanship, dimensions, design and details are reserved. Reserved are further incorrect information due to technical defects in our shop system or false information from our suppliers.

Territorial Validity of our Offers and Prices

All prices are strictly net and include value-added tax in the case of delivery prices and shipping charges. Our offers are valid in Switzerland. For electronic appliances, the Swiss prepaid recycling charge (vRG) is included in all prices. In this way, we make a contribution to the environmentally friendly disposal of light fixtures. The indicated delivery prices and shipping charges shall not apply to any orders with delivery addresses at remote locations. For such orders, please enquire about our conditions of shipment or delivery. We shall be happy to make you a favourable offer.

You are automatically subscribed to our newsletter when making a purchase. By subscribing to our newsletter, you also agree to receive information about special offers, surveys or other marketing campaigns on all channels: email, SMS, WhatsApp, Facebook, Messenger, Skype and others. Vouchers and Promotional Campaign

If not otherwise specified, a voucher is only redeemable in our shop at beliani.ch for products and does not apply to any services. Vouchers can only be used for one order and cannot be exchanged for cash/gift cards or used in conjunction with any other voucher or promotional code. The remaining value of not-redeemed vouchers is not refundable and cannot be converted into cash. Vouchers cannot be used against previous orders and are only valid for promotional offers while stock lasts, and during the timeframe described in the offer.

Bundle Orders

In case of a large order, the delivery time can be delayed between 1-2 weeks.

We offer in-home delivery and assembly service for almost all our furniture. The products excluded from these services: lamps, waterbeds, hot tubs. The old furniture intended for disposal cannot exceed the sizes of the delivered furniture.

In case when only a part of the ordered products is in stock and the customer requests a partial delivery, we offer the assembly service only with the first delivery. The remaining part of the order is delivered without the bonus services.

For a partial return, the amount of money for the returned product equals a percentage of the product price in proportion to the sum for the entire order.

Delivery

We deliver our goods within the specified delivery times according to the item description on our website with the exception of unexpected circumstances we cannot be held responsible for.

There is no right to compensation in the event of delay of delivery as well as not delivering the goods within set delivery dates.

Delivery is usually free, except the following destination where delivery is logistically more challenging:

In these locations, we charge a fee of CHF 99 for the delivery of the product.

If you have ordered no additional service, such as home delivery, assembly or disposal of an old piece of furniture, delivery is only up to the curbside, maximum to where the forwarder can come with his vehicle. Deliveries on islands, in traffic-free zones or in non-truck-capable roads are not possible.

The product is delivered into the room of your choice (must be accessible via a standard staircase). The purchased product is assembled on-site (excluding whirlpools, bathroom cabinets, electrical installations and filling the waterbed). The installation of storage items and lamps on walls and ceilings is not included. In case of disposal, old pieces of furniture have to be disassembled and properly prepared for shipping (maximum weight per piece: 60 kg). If a piece of furniture is in poor condition, it must be accordingly secured. For each piece of furniture delivered, the client is entitled to dispose exactly one old piece of furniture. The disposal does not include household appliances. Since this additional service has to be planned with external partners, the delivery time can be extended by up to 2 weeks. The customer is obliged to help to carry the products inside if their weight exceeds 60 kg. Note that this service may not be available in some parts of the country. Beliani takes no responsibility for any damage caused by the transport service provider.

Deadlines and time frames provided refer to working days, not calendar days.

Certain products are shipped from the manufacturer to the consumer with a disposable pallet for one-time transportation. The disposable pallet is part of the consignment and must be disposed of by the consignee at their own expense together with the carton and other packaging material unless otherwise agreed. Shipping companies only take reusable pallets.

If the Customer wishes that the ordered goods are still delivered and stored in their absence, this will be honoured at the Customer’s risk. In case of loss or damage of this unacknowledged shipment (s), the Customer will not make claims of any kind against either the delivery company or the Seller. The Customer is aware that a claim of the sender for the payment of the consignments delivered in this form remains in place and valid in case of loss or damage. The revocation of this agreement must be made in writing immediately.

If the service of Home Delivery, Assembly or Disposal has been booked and the order is not cancelled within 7 working days, the full cost of those services will be charged to the Customer.

If a customer wishes to postpone the delivery date after the goods have already been sent to the local depot, additional storage fees may apply.

Please remember that at the customer's request, the cardboard box can be disposed of by the transporter during assembly. However, if you wish to return the furniture, all products must be disassembled, provided in the original box and made ready for pickup on the curb. Some products are delivered to the customer directly from the producer on the disposable palette. A disposable palette, which as in the case of cardboard and other packaging should be removed by the customer at his own cost. The delivery company does only collect reusable pallets.

Payment Methods: Purchase Invoice

The amount invoiced becomes due at the latest by the date stated on the invoice on the account of our external partner, Klarna, indicated in the invoice, to pay. The payment method Purchase on the account does not exist for all offers and requires, among other things, a successful credit check by Klarna. If the purchase on account is allowed for certain offers, after checking the Customer’s credit background, the settlement of the payment takes place in cooperation with the Klarna, which takes over the invoice claim of the dealer after the completion of the purchase contract. We will also be responsible for general Customer inquiries (such as merchandise, delivery time, shipping), returns, claims, revocations and shipments or credits when purchasing for Billypay's account.

If you do not comply with your payment obligation, you will be in default of payment at the end of the payment period set without further reminder and will have to pay default interest of 8%. Klarnais entitled to charge a reminder fee of up to CHF 30.00 per payment reminder as well as other fees, in particular the costs for a possible collection procedure. Furthermore, Klarna may in future refuse to process the payment of purchase contracts, including in relation to other traders. The General Terms and Conditions apply to Klarna.

Our cooperation partner Klarna uses third party tools to detect and prevent fraud. Data obtained with these tools may be stored and encrypted with third parties so that they are readable only by Klarna. Only when you select a payment method of our cooperation partner Klarna, this data will be used, otherwise, the data expire automatically after 30 minutes. Payment Methods: Purchase by Direct Debit

The buyer makes payment amount for immediate payment by direct debit through our external partners Klarna by the date specified in the order process checking account at the bank indicated there (the current account) is due, Hereby authorize the Klarna revocable to collect by you by the purchase by direct debit payments to the current account by direct debit. If the checking account does not have the required cover, the account-holding bank has no obligation to redeem it. Partial redemptions are not made by direct debit.

The payment method Purchase by direct debit does not exist for all offers and requires, among other things, a successful credit check by Klarna and a giro account kept in Germany. If the Customer is allowed to purchase by direct debit for certain offers after checking the creditworthiness, the payment will be processed in cooperation with Klarna, to which we assign our payment claim. In this case, the Customer can only make payments to Klarna with a debt-discharging effect. We will also be responsible for general Customer inquiries (such as merchandise, delivery time, shipping), returns, claims, revocation and shipments or credits through Klarna's "direct debit" purchase. The General Terms and Conditions apply to Klarna.

By specifying the current account, you confirm that you are entitled to direct debit via the corresponding current account and will provide the required coverage. Return debit notes are associated with high costs and costs for us and Klarna. In the case of a return debit (for lack of the required coverage of the current account, due to expiration of the current account or unauthorized objection of the account holder) authorize Klarna to submit the debit for each overdue payment obligation once again. In such a case, you are required to pay a processing fee of EUR 12.00 per return debit. Further claims are reserved. You will be given the opportunity to prove that the return debit has resulted in lower or no costs. Given the expense and cost of chargebacks and avoid the processing fee we ask you in the event of a cancellation or withdrawal from the contract, not to oppose a return or a complaint, the direct debit. In such a case, after consultation with us, the repayment of the payment by remittance of the corresponding amount or by credit.

For Direct bank transfer, your personal data such as contact and order details will be processed by Klarna.

For instalment payments: flexible instalments of up to 24 months, with no fixed term. The loan application requires only a few details and is completed in few seconds.

The copyright to the design of our website and to its contents, including but not limited to texts and graphics, is held entirely by the Seller. Without our prior written consent, it shall not be permitted to copy, download or otherwise use any part thereof for one’s own purpose. This shall not apply to our special links that are provided for downloading.

Liability and Applicable Law

We shall not be liable for any damage that we could not have influenced ourselves. For any damage which results from the purchase, shipment or use of the products and which we could have prevented, we shall be liable up to the purchase amount of the product. The maximum amount of loss shall be limited to CHF 500 in any case.

Complaints, Warranty and Returns

Our products have a 2-year warranty. The guarantee period commences on the day of delivery. Any complaints shall be made as soon as possible after the receipt of the goods. Any defects emerging at a later date, i.e. during the warranty period, shall be reported immediately after their discovery. Complete information about the damage, including evidence, must be collected and presented to the Seller by the Buyer within 7 days of reporting the issue.

To claim the warranty the Buyer is obligated to show the sales document.

Customers can lodge complaints about their products and orders. These can be addressed by contacting the seller's customer support. Alternatively, customers can create complaint tickets using the My Orders function, located in the My Account section of the website.

Any damage resulting from wear and tear, ageing or improper handling shall be excluded from the warranty. Minor damages are defined as any damages not noticeable with a bare eye in natural lighting conditions from the distance of 3 meters standing diagonally to a damaged product. In case of minor damages, any claims against the seller are unfounded. The warranty shall expire if the goods have been processed or altered despite recognisable defects. Our furniture is intended solely for private, personal and non-commercial use. The guarantee does not cover any damages resulting from any kind of commercial application.

Defects shall be rectified by the Seller free of charge unless the Seller prefers to provide faultless goods by way of replacement. Any further claims shall be excluded. For defects that are not covered by the warranty of the seller, the buyer will receive a suitable offer. Under warranty, the customer has to return at his expense the goods within 14 days after discovery of the defect to the warehouse address the seller is specifying. In case of replacement, the customer pays for shipping expenses.

All the services (payment fees, home delivery, installation, etc.) are excluded from the refund. In the case of technical products or built-in appliances, the customer has to identify the faulty part himself or ask a qualified technician to do so, and send the item to us.

The warranty expires if the whirlpool or bath is not installed by an authorized and qualified specialist. The work report should be presented on request.

The costs related to the diagnosis of the defect and the replacement of parts shall be covered by the customer. Warranty is a parts only warranty unless otherwise stated. Any installation costs to correct any issues will not be covered by the seller. For warranty claims or damage reports, we will require photographic or electronic media evidence of the damage or proof to confirm the report of issues.

Mattresses Warranty

Because we strongly believe in the high quality of our mattresses, we give a 2-year warranty. The warranty covers defects related to the mattress design and construction. Applies to private use only. The warranty covers the following defects:

  • springs in spring mattress
  • filling in foam mattress
  • filling in a latex mattress
  • the electric motor in electric, adjustable bed (a two-year warranty)

The warranty does not apply to the mattress pad and topper. Furthermore, it does not cover defects related to inappropriate use e.g. splitting, tears, sagging, scratches, and stains caused by the buyer after the product delivery. In such cases, the warranty does not apply. The warranty is also not applicable to any defects resulting from improper use, bad assembly, lack of maintenance or incidental and consequential damages. The warranty does not apply in case of improper repair attempts, alteration or customization by an unauthorised person. The warranty does not cover zippers, handles and moulding of the product. Repair or replacement of the product does not change the warranty duration. The warranty is only valid if the correct bed frame was used for the product. In the case of a pocket mattress with flexible cold foam or latex mattress, the bed frame should have at least 26 slats. The client must send the product at their own expense to our warehouse for damage evaluation. If the product is withdrawn from sale by that time, the seller decides on a proper replacement.

Returns

In accordance with consumer law, the buyer may withdraw from the purchase contract within 14 days of receipt of the goods without giving any reason.

Up to 14 days from the delivery date, a customer can return ordered items for free (exceptions apply). We will offer a free return and issue a full refund in the same method as your original payment. The exception for free return up to 14 days includes orders with original packaging missing, orders of bathtubs, whirlpools, hot tubs, as well as custom made products. In these cases, a customer bears transportation costs.

After 14 days, a customer needs to cover the return cost. Refund will be issued in the form of a voucher to be used at beliani.ch within 360 days. Excluded from returns after 14 days are bathtubs, whirlpools and hot tubs, as well as custom made products. We will only accept returns of products that were not used, assembled, or installed. We will accept returns of products repacked securely in the original packaging.

In order to withdraw from the sales contract, the buyer has to provide the seller with a declaration within 14 days of receipt of the goods. The buyer then receives the ticket number, which must be attached to the returned goods. Returns without this number will not be accepted.

Unpaid parcels will not be accepted.

The goods must be packaged in such a way that they can be transported and be ready for return transport on the curbside. If the original packaging is not available, the customer must provide suitable alternative packaging himself so that the product is adequately protected during transport. The buyer should take a photo of the shipment before sending it back and send the photos to the seller.

If the returned item is in a different condition after the assessment than the item originally sent to the recipient, e.g. mechanical damage caused during assembly or dismantling or signs of wear, we reserve the right to charge the costs for spare parts or depreciation of the item caused by damage deduct.

After receipt of the goods, the buyer receives his money back within 7 days using the same payment method as he paid himself. Unless a different method of payment is agreed with the buyer, but without hidden additional costs for the seller.

Please note that the refund amount will be reduced by the value of the promoted voucher or product in the event of a return. The first exchange or return of the products that have been partially or fully paid for with a voucher is free of charge. In the event of more than one exchange or return, products must be returned at the Buyer's expense.

Business Customers
If the order is cancelled at any stage or the goods are returned, the customer will bear the operating costs.

We also grant a prolonged return period of 365 days, however only for unused and brand-new items, preferably in original packaging. The money is refunded in the form of a voucher and the Buyer bears the return transport costs.

Transportation risks, damages and transport insurance

Transportation is at the risk of the customer but is partially covered by transport insurance. The customer is obliged to immediately review the accuracy, completeness and integrity of the goods delivered or picked up. The damage of the goods delivered or collected must be reported to us no later than 24 hours after delivery by written notification. The original packaging must be kept by the customer in case of a claim, it should only be disposed of after written confirmation from us. At the end of the order process, the client can optionally purchase a transport warranty, it may cover any loss and damage during transportation. A transportation warranty covers damage and loss during the transport up to the value of the goods at the time of ordering. The customer can only get a repair, exchange (new delivery) or financial compensation up to the value of the goods. The decision to repair, exchange or financial compensation can be decided only by the seller. The damage of the goods delivered or collected must be reported to us by e-mail within 24 hours. The customer is obliged to meet these deadlines to take advantage of the warranty. The shipping warranty is not available if it was not purchased during the ordering process. In case of a product return, the amount of the transportation warranty will not be refunded. Repairs carried out by the customer without consent from us can not be further processed in the warranty.

The buyer should dispose of damaged items at his own expense, in agreement with the seller.

In the event that a product is received with transportation damage not documented by the customer and confirmed by the shipping company (in Proof Of Delivery), we reserve the right to charge the customer for return shipment costs.
